Data Notice (EU Data Act Transparency)

1. Document Scope
This notice explains what device data is generated, stored, used, and shared when you use the Klarstein Mobile Application with Chal-tech GmbH smart devices. It is intended for end-users and partners, reflecting our transparency obligations under the EU Data Act. It does not replace our Privacy Policy or Terms; rather, it complements them by focusing on device-generated data (sometimes called “product data” or “usage logs”)

2. Identity of the Data Holder
Chal-tech GmbH (hereinafter referred to as “we” or the “Data Holder”) is the provider and operator of the Klarstein Mobile Application. When users use our products and related services, devices will generate and process data. Contact details:

3. Types and Attributes of Generated Data
Our products and services may generate product configuration data, usage logs, basic information, and more.

5. Data Storage and Use
5.1 Data Storage
• Data is stored on remote servers
• Product usage logs (Datapoints) are retained for 7 days by default, then automatically deleted
• Product configuration data is stored until the user unbinds the device or deletes the App account
Use: We use data only for fulfilling contracts, security, troubleshooting, product improvement, or advertising (where applicable).
5.2 Data Sharing
At Klarstein, we only share Personal Data in ways that we tell you about. We may share your Personal Data with the following recipients:
• To our third-party service providers who perform certain business-related functions for us, such as website hosting, data analysis, payment and credit card processing, infrastructure provision, IT services, customer support service, e-mail delivery services, and other similar services to enable them to provide services to us
• To our customers and other business partners who provide you, directly or indirectly, with your Smart Devices, and/or networks and systems through which you access and use our websites and Services
• To subsidiaries or affiliates within our corporate family for purpose of regular business activities based on our instructions and in compliance with applicable law, this Policy and other appropriate confidentiality and security measures
• To an affiliate or other third party in the event of any reorganization, merger, sale, joint venture, assignment, transfer or other disposition of all or any portion of our business, assets or stock (including without limitation in connection with any bankruptcy or similar proceedings). In such an event, you will be notified via email and/or a prominent notice on our website of any change in ownership, and choices you may have regarding your Personal Data
•As we believe in good faith that access to, or use, preservation, or disclosure of the information is reasonably necessary or appropriate to:
(a)Comply with applicable law, regulation, legal process, or lawful governmental request
(b)Enforce our User Agreement and other agreements, policies, and standards, including investigation of any potential violation thereof;
(c) Protect our operations and business systems;
(d)Protect the rights, property, or safety of us, our users, a third party, or the public as required or permitted by law; or
(e)Perform risk management, screening, and checks for unlawful, fraudulent, deceptive, or malicious activities.
Except for the third parties mentioned above, we only disclose your Personal Data to other third parties with your consent.
6. User Rights
6.1 Data Access
You can directly view, download, or export device data through the App interface. Operation path: App → Me → Settings in the upper right corner → Privacy Policy Management → Device Data Export → Select Device → Click “Export” → Enter email to receive data.
6.2 Data Deletion
• You can delete your data at any time: Unbind the device in the App and choose “Delete Data”; or
• Delete your App account.
6.3 Righ to Complain
You have the right to lodge complaints regarding our data processing practices with the competent authority of your country or region of residence
7. Data Sharing Options
7.1 One-time Sharing
You can export data via the App and provide it to third parties yourself.
7.2 Continuous Sharing
You may continuously share device data with third parties via an authorization QR code:
• The third party must register and subscribe to cloud services at https://platform.tuya.com/cloud
• The third party applies for an authorization key and generates an authorization QR code
• You scan the QR code and select authorized devices in the App
• You may revoke authorization at any time via App → Me → Devices → Account & Security → Cloud Development Projects
8. Protection of Trade Secret
Some device data may include information considered trade secrets (eg, unique operational logic, proprietary performance parameters). Where applicable, we will clearly indicate such information and assert that these trade secrets belong to Chal-tech GmbH.
9. Term of the Agreement
This notice remains in effect for as long as your account is active. You may terminate by deleting your account (which also triggers data deletion as outlined above, subject to any legally required retention).
10. Definitions
Device-generated data: Data produced by the device during configuration, status reporting, and usage (eg, temperatures, modes, error codes).
Configuration data: Settings and preferences you or the system apply to the device (eg, target temperature, light mode).
Usage logs: Time-stamped records of state changes, events, and device telemetry collected during operation.
